Deciding to separate from your partner can bring uncertainty about your home, finances and what life will look like in the months and years ahead. Even where you remain on good terms, having clarity over the practical and financial arrangements between you can help prevent misunderstandings and give you both greater confidence about the future.

A separation agreement can record what you and your former partner have agreed following your separation. Depending on your circumstances, this might include arrangements concerning the family home, savings, debts, personal possessions and ongoing financial commitments. For married couples and civil partners who are not yet ready to divorce or dissolve their civil partnership, it can also provide a framework for managing their finances while they live separately.

At Pinnington Law, our Separation Agreement Solicitors in Manchester provide practical, considered advice to help you understand whether a separation agreement is appropriate for your circumstances and what should be included within it. We will take time to understand what matters most to you, explain the implications of the agreement clearly and work towards arrangements designed to provide as much certainty as possible.

Stephen and Clare Pinnington have more than 50 years of combined Family Law experience. They are supported by the wider expertise and resources of the Farnworth Rose Solicitors Group, enabling us to provide joined-up assistance where a matter involves Family Law, property ownership, disputes, Wills or estate planning.

What It’s Like Working With Pinnington Law

When you choose Pinnington Law for advice on a separation agreement, here’s what you can expect:

  • You work with one dedicated family law specialist from start to finish.
    ○ Your solicitor will take the time to understand your relationship, your financial circumstances and what you want the agreement to achieve, while remaining your consistent point of contact throughout.
  • We begin by helping you understand where you stand.
    ○ Before any agreement is drafted or reviewed, we explain the legal position clearly, including what a separation agreement can achieve and any limitations you need to be aware of.
  • We identify the issues that need to be covered.
    ○ Depending on your circumstances, this may include the family home, mortgage payments, savings, debts, maintenance, household expenses and other financial responsibilities following separation.
  • We agree an approach based on what matters most to you.
    ○ You may want greater financial certainty, a clear record of what has already been agreed, protection for particular assets or a practical arrangement while you decide whether to divorce. Our advice is shaped around your priorities.
  • We look beyond the document itself.
    ○ A separation agreement can have wider implications, particularly if you later decide to divorce or dissolve a civil partnership. We help you understand how the decisions you make now could affect your position in the future.
  • We aim to keep discussions constructive wherever possible.
    ○ If terms still need to be agreed, we can support you through solicitor-led negotiations and help work towards a practical agreement without creating unnecessary conflict.
  • We make sure you understand the agreement before you sign it.
    ○ We explain the terms in straightforward language, highlight any areas of concern and make sure you understand the practical and financial consequences of what is being proposed.
  • We give clear and realistic advice.
    ○ If we believe a proposed term could leave you exposed or may not achieve the certainty you are looking for, we will tell you and explain the options available.
  • You receive direct communication and transparent information about costs.
    ○ We will keep you updated, respond promptly and explain the fees involved so that you know what to expect throughout the process.

During your first conversation, we will discuss why you are considering a separation agreement, what has already been agreed between you and your former partner, and what you would like the agreement to achieve. From there, we can advise you on the most appropriate next steps.

What is a Separation Agreement?

A separation agreement is a written agreement recording arrangements made between a couple following the breakdown of their relationship.

It can be particularly useful where a married couple or civil partners have decided to live separately but do not currently want to divorce or formally dissolve their civil partnership. It may also help provide clarity during the period before divorce or dissolution proceedings and the final resolution of financial matters.

The contents of an agreement will depend entirely on your circumstances. It can record how you intend to deal with property, household expenses, savings, debts and other financial responsibilities while you are separated.

It is important, however, to distinguish a separation agreement from a financial order made by the Family Court. If a married couple or civil partners subsequently divorce or dissolve their civil partnership, an agreement between them does not automatically prevent the court from considering financial claims. Where a divorcing couple agrees how their money and property should ultimately be divided, a consent order approved by the court is generally required to make those arrangements legally binding within the divorce proceedings.

That does not mean a carefully prepared separation agreement is without value. The circumstances in which an agreement was reached, the information available to each person and the fairness of the arrangements can all be important if financial matters are considered later.

Our separation agreement solicitors can explain what the document will and will not achieve and help ensure that you enter into any agreement with a proper understanding of its implications.

Would a Separation Agreement be Right for Me?

A separation agreement may be worth considering if you and your partner have decided to separate and want greater certainty about how your financial affairs will operate.

You may have decided that you need some time apart before making a final decision about divorce. You might have personal, practical or religious reasons for remaining married despite living separately. Alternatively, you may simply want to establish clear financial arrangements now while considering your longer-term options.

An agreement can also be valuable where you have been able to discuss matters constructively and want a written record of what has been decided. Verbal arrangements can be interpreted differently as time passes. Recording your understanding clearly can reduce uncertainty and provide both parties with a point of reference.

However, signing an agreement simply because you want matters resolved quickly is not always advisable. Before agreeing terms, it is important to understand your financial position and what you may be giving up. If significant assets, property, pensions, businesses, investments or substantial differences in income are involved, obtaining appropriate advice becomes particularly important.

The suitability of a separation agreement also depends on what you ultimately want to achieve. If you have made the final decision to divorce and want to resolve your financial relationship conclusively, it may be more appropriate to consider divorce alongside a financial consent order rather than relying upon a separation agreement alone. Government guidance confirms that couples who want an agreed division of money and property to become legally binding on divorce need to ask the court to approve a consent order.

At Pinnington Law, we will look at the wider picture before recommending a particular approach. Our priority is to help you choose the solution that best protects your position and supports the future you are working towards.

Our Process for Preparing a Separation Agreement

We will start by understanding your circumstances, what has already been agreed and what you want the separation agreement to achieve. We will also explain what financial information may need to be shared before terms are finalised.

Once the position is clear, we can help negotiate any outstanding issues and prepare or review the agreement so that it accurately reflects the arrangements you have reached. Your former partner will usually be advised to obtain independent legal advice before the agreement is signed.

Before you commit to the agreement, we will explain its terms, any potential risks and how it could affect your position if you later decide to divorce or dissolve your civil partnership.

Why Choose Pinnington Law

Choosing the right solicitor matters. Separation involves deeply personal decisions and can have significant consequences for your finances, your home and your future. You should feel confident that the person advising you understands both the legal details and what those decisions mean in practical terms.

At Pinnington Law, we put your circumstances at the centre of our advice. We take time to understand why you are considering a separation agreement, what has already been discussed between you and your former partner, and what you need the agreement to achieve.

We believe good family law advice should make a difficult situation clearer rather than more complicated. We will explain your options in straightforward terms, identify issues that require attention and help you understand the advantages and potential limitations of the arrangements being proposed.

Where negotiations are required, we will approach them constructively and strategically, looking for solutions that protect your interests without encouraging unnecessary conflict. Where an agreement has already been prepared or proposed by your former partner, we can review its terms independently and advise you on the implications before you decide whether to sign it.

Most importantly, our advice will be personal to you. A separation agreement can influence important financial decisions for years to come, so we will never treat it as simply another document to be signed. We will help you consider the wider implications and work towards an arrangement that gives you the strongest possible foundation for moving forward.
